Lafayette attorney Marcus Allen has entered into a two-year probation program with the state Office of Disciplinary Counsel, which oversees attorney conduct in Louisiana. The Supreme Court signed of Louisiana off on the agreement earlier this month. The agreement allows Allen to dodge a one-year suspension of his law license.
According to the SCOLA consent decree, Allen was investigated by the ODC for allegedly failing to "timely remit funds to third-party medical providers." Before formal charges were filed against him, however, he and the ODC submitted a joint petition for consent discipline to which the supreme court justices agreed. The consent decree indicates that if Allen fails to meet the terms of his probation the one-year suspension could still be imposed.
This is the latest pothole in Allen's legal career. In August 2010 he was fired from his position as assistant city prosecutor by then city-parish attorney Pat Ottinger after LCG's top lawyer ordered Allen to resign following an arrest for simple battery stemming from a scuffle with a bail bondsman.
