The IND confirmed the reason for Tuesday's continuance with the minute clerk on duty Tuesday, who says, "His lawyers had another case somewhere else they had to be at."
Hebert's lawyers are Stephen Spring II and Christopher Alexander, a legal tag-team from Baton Rouge who, according to our sources, are making a name for themselves in the 15th Judicial District for their courtroom antics and appetite for "high-profile" conspiracy cases (read that story here).
In fact, the "out-of-town trial" bit, our sources say, is one of their best known delay tactics, and is especially a favorite for those cases in which the client's outcome isn't looking too good. Tuesday's motion marks the second last-minute continuance filed in the Hebert case. The last continuance granted in Hebert's felony case came July 9 because he was "hospitalized" the night before his trial date.
Thanks to Tuesday's motion, Hebert gets an extra three months before he'll finally stand trial, which, unless another continuance is granted, is scheduled for Dec. 2. With two counts of cyberstalking and one count of stalking, Hebert faces up to two years in prison and fines of up to $3,000, if convicted. The charges stem from his 2011 arrest for allegedly threatening - by phone and Internet - a female victim.
