Third Circuit affirms Marinello murder conviction

The Third Circuit Court of Appeal has backed a lower court's conviction of the former New Orleans broadcaster. The Third Circuit Court of Appeal has backed a lower court's conviction of Vince Marinello. The former New Orleans sports broadcaster was convicted in Lafayette - the trail was moved out of the New Orleans area due to heavy media coverage and the need for an unprejudiced jury - in December 2008 in connection with the August 2006 shooting death of his estranged wife, Liz Marinello, who was shot twice in the face by an disguised assailant who escaped on a bicycle.

In his appeal, Marinello enumerated eight errors at his trial, among them insufficient evidence against him, the trial court's refusal to disqualify the Jefferson Parish District Attorney's Office from prosecuting the case, the trial court's refusal to suppress cell phone records and the prejudicial behavior of prosecutors during the trial.
