Two critical pieces of evidence in the drunk driving trial of a Lafayette school bus driver have been tossed.
A typographical error by a former state trooper who incorrectly logged the serial number of a tuning fork used to calibrate his radar gun has Lafayette Parish School System bus driver Kenny Mire in the catbird seat. According to The Daily Advertiser, the judge who will preside over Mire's drunk driving trial Friday in state district court has now thrown out what are likely the two most critical pieces of evidence against him: the radar results - based on incorrect serial number - and the results of a Breathalyzer test that Judge Ed Rubin ruled was improperly administered.
Although he has not been convicted, Mire's September 2009 arrest was his third for suspected drunken driving. He has been on paid leave with the school system since late 2009.
