Supreme Court refuses to hear case dismissing blame against Army Corps

The U.S. Supreme Court gave no reason for refusing to review the September 2012 decision by the U.S. 5th Circuit Court of Appeals that threw out a lower court judgment finding the Army Corps of Engineers partly to blame for catastrophic flooding in some neighborhoods after Hurricane Katrina.

The Times-Picayune reports that the U.S. Supreme Court on Monday refused to review the September 2012 decision by the U.S. 5th Circuit Court of Appeals throwing out a multi-billion-dollar judgment against the Army Corps of Engineers that found the agency partly to blame for catastrophic flooding in some New Orleans area neighborhoods after Hurricane Katrina.

The appeals court had found that the Army Corps of Engineers is not liable for billions of dollars in flood damage in the Lower 9th Ward and St. Bernard Parish  that a lower court said resulted from the agency's failure to maintain the Mississippi River-Gulf Outlet. The court said the corps was immune from damages in a lawsuit due to a provision protecting an agency that makes a discrection decision.

The U.S. Supreme Court gave no reason for refusing to hear the case.
