A pair of Republican state representatives have filed suit against the state of Louisiana seeking to force a review of whether the 2012-2013 Louisiana state budget is constitutional. The pair - Rep. Kirk Talbot of River Ridge and Cameron Henry of Metairie - contends the budget, which relies on one-time sources of revenue and contingencies, is unconstitutional.
State Attorney General Buddy Caldwell and Treasurer John Kennedy are named as defendants in their official capacities. Talbot and Henry asked Caldwell for an opinion on the budget's constitutionality last fall but Caldwell declined, arguing that if his office found the budget to pass constitutional muster it would be forced to defend it in court if Talbot and Henry filed suit.
So Talbot and Henry filed suit.
The petition for declaratory judgment, reproduced below, was filed in state district court in Baton Rouge.
