The red light camera program in Baton Rouge is yet to begin issuing tickets, but lawyers are already suggesting that once it does, a lawsuit will be filed. WAFB in Baton Rouge is reporting that attorneys from the firm of Joseph McMahon III in Jefferson Parish, the same firm that has already filed suit against traffic camera programs in Lafayette and in Jefferson Parish, are already eyeing a similar legal challenge in the capitol city.
One of the firm’s lead attorneys, Anthony Maska, tells WAFB, "We believe there's problems with the constitutionality of this statute in the way that it's enforced, which ignores certain due process rights and other rights protected by the Constitution." Any suit would not be filed until after the program is fully operational and began ticketing a significant number of violators. Thus far, Baton Rouge only has cameras in place at one intersection, with plans in place to install four more in the coming weeks. Baton Rouge contracts with the company American Traffic Solutions to install and operate its cameras. The Lafayette and Jefferson Parish programs are run by Redflex Traffic Systems.
