NEW ORLEANS (AP) — A state judge in New Orleans is set to hear arguments on whether he should order a physical and mental examination of Saints and Pelicans owner Tom Benson.

Tuesday's hearing before Civil District Judge Kern Reese is the latest development in a lawsuit filed by Benson's daughter, Renee, and her children Rita and Ryan LeBlanc. They want the 87-year-old Benson declared incapable of handling his own affairs.

They filed the suit in late-January after they were removed from Benson's succession plan for his teams.

Tom Benson's lawyers are seeking dismissal of the lawsuit. They filed an answer saying Benson made a "deliberate, reasoned and difficult decision" to eventually leave control of the teams with Gayle Benson, his wife of 10 years.
